A US judge has just ruled that there’s enough evidence to back up Musk’s lawsuit against OpenAI, its co-founders Sam Altman and Greg Brockman, and the AI research organization itself. This means that the trial is now likely to go ahead, and we can’t wait to see how it all unfolds.

    For those who may not be familiar with the background, this whole thing started back in 2018 when Musk resigned from the OpenAI board after his bid to take over as CEO was rejected. At the time, he cited potential conflicts of interest with Tesla’s own AI development for self-driving cars. Since then, he’s been a vocal critic of OpenAI’s decision to switch to a for-profit model, even making an unsolicited $97.4 billion bid to buy the company in February 2025, which was rejected by Altman.

However, in 2019, the organization started to shift away from its non-profit roots by creating a for-profit subsidiary with a “capped-profit” model that limited investor returns. Musk claims that he invested around $38 million in early funding, as well as his time and credibility, based on assurances that OpenAI would remain a non-profit. He’s now seeking financial damages from what he claims are “ill-gotten gains” by OpenAI.

    An OpenAI spokesperson was quick to respond to the news, calling Musk’s lawsuit “baseless and part of his ongoing pattern of harassment.” But for now, it seems that the judge has sided with Musk, ruling that there’s evidence showing that OpenAI’s leaders made assurances that its original non-profit structure would be maintained.
